Paul Bailey Construction LTD

These Terms & Conditions govern the contract between Paul Bailey Construction LTD (“the Company,” “we,” “us”) and the client (“you,” “your”) for building and construction services. By accepting our quotation and paying the deposit, you agree to be bound by these terms.

 


1. Quotation Validity & Acceptance

1.1 All quotations are valid for 30 days from the date of issue unless otherwise stated.

1.2 Quotations are based on the specifications, measurements, and site conditions assessed at the time of survey. Any variations discovered during works may result in additional costs.

1.3 Acceptance of the quotation is confirmed upon receipt of the deposit payment.

1.4 All pricing is exclusive of VAT unless otherwise stated. VAT at the prevailing rate will be added to all invoices.

 


2. Deposit & Payment Terms

2.1 To secure your project start date, a non-refundable deposit of £500.00 + VAT is required.

2.2 We operate a no upfront costs policy. You will never be asked to pay in advance for materials or labour beyond the initial deposit.

2.3 Payment is due upon completion of each stage of work, as outlined in your project schedule, and after Building Control inspections have been passed (where applicable).

2.4 Invoices are issued every two weeks following the deposit payment.

2.5 Payment must be made within 3 days of invoice date unless alternative arrangements have been agreed in writing.

2.6 Payment can be made by bank transfer, cheque, or other agreed methods.

2.7 Failure to make payment in accordance with these terms may result in suspension of works until payment is received.

2.8 Payment plans (typically 4 months) may be available for unforeseen extra costs, subject to approval.

 


3. Variations & Additional Works

3.1 Any changes to the agreed specification must be confirmed in writing and may result in additional costs and extended timescales.

3.2 Verbal change requests will be followed up with written confirmation and a revised quotation before works proceed.

3.3 Common additional works include extra electrical fittings, tiling, and structural modifications discovered on-site.

3.4 Additional works will be invoiced within the same two-week invoicing cycle.

 


4. Project Timeline & Delays

4.1 Estimated project timelines are provided in good faith based on normal working conditions.

4.2 We aim to complete 80–90% of projects on time, subject to factors beyond our control.

4.3 The Company is not liable for delays caused by: - Adverse weather conditions - Late delivery of materials by suppliers - Delays in Building Control or planning approvals - Discovery of unforeseen structural issues or hazardous materials - Client-requested changes or delays in decision-making - Access issues or third-party interference

4.4 We will inform you promptly of any anticipated delays and work to minimize disruption.

 


5. Client Responsibilities

5.1 You must provide access to: - Mains water supply (please inform us of the location of the stop valve) - Mains electricity supply - The property during agreed working hours (typically 8:00 AM – 5:00 PM, Monday to Friday)

5.2 You must inform us of the location of: - Electric cables and meter - Gas pipes and meter - Phone lines - Water pipes and drains - Any other service lines or utilities

5.3 You are responsible for: - Removing or protecting personal belongings and furniture in work areas - Making alternative arrangements if the property will be uninhabitable during works - Ensuring pets are secured and do not interfere with works - Informing us of any known hazards (e.g., asbestos, structural issues)

5.4 You must obtain any necessary permissions from freeholders, landlords, or managing agents before works commence.

 


6. Building Regulations & Compliance

6.1 All building work will be carried out in accordance with current Building Regulations.

6.2 Building Control inspections will be arranged at appropriate stages throughout the project.

6.3 A Certificate of Compliance will be supplied by the local authority once all works are completed and inspections have been passed.

6.4 An Electrical Installation Certificate will be issued upon completion of electrical works by our certified electricians.

6.5 This quotation is subject to receipt of building regulation drawings and structural drawings (if applicable).

 


7. Planning Permission & Regulatory Fees

7.1 Planning permission fees, applications, and associated costs are not included unless specifically stated in the quotation.

7.2 Building Control application fees are not included unless specifically stated. These can be arranged by your architect, yourself, or by us at an additional cost.

7.3 Structural engineer’s fees for calculations and drawings are not included unless specifically stated.

7.4 Party wall agreements and associated costs are the client’s responsibility unless otherwise agreed.

 


8. Site Management & Safety

8.1 We will maintain a safe working environment in accordance with Health & Safety regulations and CDM (Construction Design and Management) requirements.

8.2 Site inspections will be carried out regularly to ensure compliance with safety protocols and correct use of PPE (Personal Protective Equipment).

8.3 The site will remain the Company’s responsibility during working hours. Outside of these hours, the client is responsible for site security.

8.4 Waste disposal and site cleanup are included in the base pricing and will be carried out regularly throughout the project.

 


9. Insurance & Liability

9.1 The Company holds the following insurance cover: - Public Liability: £5,000,000 - Products Liability: £5,000,000 - Employers Liability: £10,000,000 - Contract Works: £250,000

9.2 The Company is not liable for: - Damage to items not removed or protected by the client - Pre-existing defects or damage to the property - Damage caused by third parties or events beyond our control - Settlement cracks or cosmetic issues following steel beam installation (these are normal and not considered defects)

9.3 Any damage caused by our works will be reported immediately and rectified at our expense.

 


10. Guarantee & Warranty

10.1 We provide a 5-year guarantee on labour for all completed works, subject to the conditions below.

10.2 Materials are covered by manufacturer warranties. We will provide details of applicable warranties upon completion.

10.3 An optional insurance-backed guarantee (up to 12 years) is available at an additional cost.

10.4 The guarantee is transferable to new property owners.

10.5 The guarantee is subject to: - Regular maintenance of the completed works - Defects being reported in writing within 10 days of discovery - Allowing us reasonable access to inspect and remedy defects - All invoices being paid in full

10.6 The guarantee does not cover: - Subsidence or ground movement - Vandalism, tampering, or misuse - Damage caused by excessive foot traffic or wear and tear - Damage caused by other contractors working without our consent - Damage unrelated to our works

10.7 Warranty claims must be submitted in writing. Site visits will be arranged within a reasonable timeframe.

 


11. Excluded Items

The following items are NOT included in this quotation unless specifically stated:

Utilities & Services

·      Electric and gas meters

·      New boiler or repositioning of existing boiler

·      Fuse board replacement (determined on-site by our electricians if required)

Finishes & Decorative Works

·      Floor coverings and tiling (can be added as an extra)

·      Painting, decorating, or coving (can be added as an extra)

·      Tiles or tiling work (can be priced later, subject to tile type and design)

·      Removal of existing tiles, including wall tiles (damage to plasterboard/plaster beneath is not included; making good can be priced on-site)

External Works

·      Patios, driveways, pathways, or making good (can be priced later, subject to design)

Regulatory & Professional Fees

·      Planning permission fees and applications

·      Building Control application and fees

·      Structural engineer’s fees

·      Party wall agreements

Additional Services

·      Insurance-backed guarantee (available at additional cost)

·      Removal of asbestos (quoted separately if discovered)

Scope Limitations

·      Works to existing property beyond areas directly affected by this project

·      Works to existing drains beyond connection points

·      Remedial works for settlement cracks or cosmetic issues following steel beam installation

 


12. Unforeseen Works & Structural Issues

12.1 If unforeseen structural issues, hazardous materials, or other complications are discovered during works, we will: - Stop work in the affected area - Notify you immediately - Provide a written quotation for additional works required - Await your written approval before proceeding

12.2 Common unforeseen issues include: - Asbestos requiring specialist removal - Inadequate foundations requiring additional structural work - Hidden drainage or service lines - Structural defects in existing walls or floors

12.3 Costs for unforeseen works are not included in the original quotation and will be charged separately.

 


13. Cancellation & Termination

13.1 The £500 + VAT deposit is non-refundable once paid.

13.2 If you wish to cancel the contract after works have commenced, you must: - Provide written notice - Pay for all works completed to date - Pay for materials ordered or delivered - Pay for any costs incurred in mobilizing or demobilizing the site

13.3 The Company reserves the right to terminate the contract if: - Payment is not made in accordance with these terms - Access to the site is denied - The client breaches any material term of this agreement

13.4 In the event of termination by the Company, you will be invoiced for all works completed and costs incurred to date.

 


14. Complaints & Dispute Resolution

14.1 If you have any concerns or complaints, please contact your project manager or our office immediately via phone or email.

14.2 All complaints will be investigated promptly and resolved in a fair and professional manner.

14.3 If a complaint cannot be resolved informally, it may be escalated in accordance with our formal complaints procedure.

14.4 We are members of the Federation of Master Builders and adhere to their Code of Practice.

 


15. Data Protection & Privacy

15.1 We will process your personal data in accordance with the General Data Protection Regulation (GDPR) and UK data protection laws.

15.2 Your data will be used solely for the purpose of fulfilling this contract and will not be shared with third parties except as necessary (e.g., Building Control, suppliers).

15.3 You have the right to request access to, correction of, or deletion of your personal data.

 


16. General Terms

16.1 These Terms & Conditions, together with the quotation, constitute the entire agreement between the parties.

16.2 No variation of these terms shall be valid unless agreed in writing by both parties.

16.3 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

16.4 These terms are governed by the laws of England and Wales.

16.5 Any disputes arising from this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.
